Terms of use and disclaimer

Fairsail is a record-keeping and budgeting tool. It gives information, not financial advice. Nothing in Fairsail is financial, investment, tax, accounting, legal or insurance advice, or a recommendation to buy, sell or hold anything. Decisions you make with it are your own. For advice about your situation, talk to a qualified professional.
These terms are an agreement between you and the maker of Fairsail (“we”). By using Fairsail on any device or on the web, you agree to them. If you don’t agree, please don’t use Fairsail.
1. What Fairsail is
Fairsail helps you keep your own record of your spending, budgets, savings, investments and debts, using statements and screenshots you bring in yourself. It is for personal information and education only.
2. Not financial advice
Fairsail does not provide financial, investment, tax, accounting, legal or insurance advice, and nothing in it is a recommendation, solicitation or offer regarding any security, account, product or strategy. We are not registered with any securities regulator, and we are not a financial advisor, planner, dealer, portfolio manager, accountant or tax preparer in any jurisdiction.
Features such as Next dollar, Retirement, Trajectory, What if, Goals, Financial health, Emergency fund, Debt, Investments, returns and contribution room apply general rules of thumb to the figures you enter. They do not know your full situation, including your taxes, income stability, obligations, risk tolerance or goals, and they may not suit you. Before acting on anything you see in Fairsail, consider getting advice from a qualified professional.
3. Estimates and projections
Projections, returns, net worth, payoff dates, retirement figures and similar numbers are estimates. They depend on assumptions (for example expected returns, inflation and how you will save or spend) that may turn out to be wrong. Actual results will differ, possibly a lot. Past performance does not predict future results. Nothing in Fairsail is a promise or guarantee of any outcome.
4. Accuracy of your information
Fairsail reads files and screenshots that you provide and sorts transactions automatically. Statements can be misread, duplicated, missed or mis-categorized, and balances can be wrong if transactions are missing. You are responsible for checking your figures against the official statements from your bank, card issuer, investment provider and government. Tax-related figures, including TFSA, RRSP and FHSA contribution room, are estimates only: confirm them with the Canada Revenue Agency (CRA My Account or your notice of assessment) before contributing. Fairsail is not a tax filing, accounting or bookkeeping service.
5. Your data and backups
Fairsail keeps your books on your device and does not send them to us. We never receive your statements, transactions or backups, so we cannot recover them. You are responsible for making and keeping backups, for where you store them, and for any passphrase you choose. A backup locked with a passphrase cannot be opened by anyone, including you or us, without that passphrase. Deleting the app or erasing its data can permanently delete your books unless you have a backup.
6. Security
Keep your device, its passcode and the accounts where you store backups secure. We are not responsible for anyone who gains access to your device, your backups or your storage accounts.
7. Banks and other companies
Fairsail is not affiliated with, endorsed by or sponsored by any bank, credit union, card issuer, investment provider or other company it mentions. Their names are trademarks of their owners and are used only to describe which files Fairsail can read. Export instructions for banks may change without notice.
8. No warranty
To the fullest extent permitted by law, Fairsail is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of accuracy, fitness for a particular purpose, merchantability and non-infringement. We do not warrant that Fairsail will be error-free, uninterrupted or compatible with every file.
9. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of money, profits, savings, data or opportunity, arising from your use of Fairsail or from decisions you make based on it, even if we were told such loss was possible. Our total liability for any claim relating to Fairsail is limited to the amount you paid us for Fairsail in the 12 months before the claim. Some places do not allow these limits; where they don’t, they apply only as far as the law allows, and nothing here removes rights you have under consumer protection law that cannot be waived.
10. Subscriptions
If you buy a subscription through an app store, the purchase, renewal, cancellation and any refund are handled by that app store under its terms. You can manage or cancel it in your app store account settings.
11. Ownership and licence
Fairsail, its name, logo, design and software are owned by us and protected by copyright and trademark law. We give you a personal, non-exclusive, non-transferable licence to use Fairsail for your own personal finances. You may not copy, modify, distribute, sell, rent, reverse engineer, decompile or create derivative or competing products from Fairsail or its code, except where the law expressly allows it. Your books are yours.
12. Changes
We may update Fairsail and these terms. When the terms change, the date above changes, and Fairsail may ask you to agree again. Continuing to use Fairsail after a change means you accept it.
13. Governing law
These terms are governed by the laws of the Province of Nova Scotia and the federal laws of Canada that apply there, without regard to conflict-of-law rules, except where the law of the place you live requires otherwise.
